Case 01

Malicious Prosecution

A contractor and his construction company won a jury verdict in a malicious prosecution action brought against an insurance carrier. The insurance carrier filed declaratory relief actions after the contractor tendered a construction defect lawsuit to his carrier. A prior bad-faith lawsuit had also been filed and was defeated. The trial court found that the action lacked probable cause. The only issues submitted to the jury were malice and damages. Personal injury damages were based on a claim of depression, which was handled by Baron Drexel.

Case 02

Wrongful Death — Single Vehicle Accident

32 year old woman who was rear passenger died when truck rolled over. Driver fell asleep at wheel. Accident occurred in California. Insurance policy issued in Arizona. Unique settlement utilizing conflict of law rule to maximize recovery under liability and UIM provisions.

Total recovery $500,000.

Case 03

Worksite Accident

Operator of backhoe dropped post on plaintiff causing traumatic brain injury. Complex medical testimony which was disputed. Defense attacked plaintiff for past drug use to explain cognitive deficits as well as personal family tragedies.

$1.8 million settlement. (Co-counsel)

UIM Claim

Mother was pedestrian killed by inattentive driver. Policy tendered from other driver was low. Son had UIM insurance policy which had de minimis coverage. Daughter had UIM policy of $250,000. Dispute was whether mother was resident with daughter or son.

Settlement from UIM for $218,000.

Case 05

Wrongful Death — Train Accident

Adult son killed by train as he crossed track. He took a shortcut which was commonly used. Train gave warning. Federal statutes provide defense to trains for speed. Blackbox data was in favor of the railroad. Decedent was talking on cell phone.

Settlement was $70,000.

Case 06

Premises Liability — Stairwell Fall

Tenant fell down interior stairwell. Tenant had lived in apartment for over two years. Complex damage case as plaintiff suffered from a blood condition which rendered her leg paralyzed, and injury was a fracture in that same leg.

$97,000 settlement.

Case 07

Assault

Defendant's dog was kicked by plaintiff while riding his bicycle. Dog owner then knocked plaintiff down and gave him a broken nose.

$36,750 settlement.

Case 08

Slip and Fall

64 year old disabled man attempted to dispose of garbage in a condominium dumpster and slipped on debris scattered nearby, resulting in tendon rupture.

Settled for $150,000.

Case 09

Premises Liability — Nightclub Injury

Plaintiff was a bystander in a nightclub injured by a participant of a slam dance. Unable to locate offender. Plaintiff sued nightclub owners. Plaintiff suffered a tibia plateau fracture.

Settled for $195,000.

Case 10

Rear-Ender on Bay Bridge

Plaintiff suffered whiplash and concussion. Other driver tendered a $25,000 policy.

Settled with UIM carrier for $175,000.

Case 11

Intersection Collision

Parties disputed whether the light was green or red. Plaintiff suffered a rotator cuff tear. No surgery. There were gaps in treatment.

$15.4 Million Jury Verdict

Judgment was obtained in a high-profile case where the client contracted HIV from a partner who was a member of the San Francisco Health Commission. The partner falsely stated that he had passed an HIV test when, in fact, he was suffering from AIDS.

BARON DREXEL

Baron Drexel practices law, focusing on personal injury and bankruptcy. He graduated from the University of California, Berkeley, in 1979 and earned his law degree from the University of Miami in 1985. While in law school, he received the J.B. Spence Award, an endowed scholarship, served as a member of the Law Review, and was a Fellow in Law and Economics. After graduation, he was inducted into the Order of the Coif as part of its first chapter at the University of Miami.

Baron was admitted to practice law in Florida in 1985, where he worked for a large law firm handling various types of business litigation, including banking litigation, antitrust matters, and land disputes. He also wrote and argued appeals. In 1988, he was admitted to the California Bar. He is admitted to practice in all federal and state courts in California. After returning to the Bay Area in 1988, Baron litigated many types of civil cases, including commercial disputes, construction matters, medical malpractice, and personal injury cases.

In 1996, he established his own firm with an emphasis on representing plaintiffs in personal injury cases. In 1999, Baron started a bankruptcy practice to complement his primary area of legal practice. He is committed to representing debtors in bankruptcy and injured victims in personal injury matters.

In his bankruptcy practice, Baron has represented more than eight hundred clients, assisting them with filing for and obtaining discharges under Chapter 7 and Chapter 13 of the Bankruptcy Code. His previous experience representing banks and handling real estate matters has provided him with valuable knowledge for representing bankruptcy clients.

In his personal injury practice, Baron has handled cases ranging from routine fender benders to head-on collisions, dog-bite attacks, slip-and-fall accidents, gas and fire explosions, wrongful death, and legal and medical malpractice. He has taken on insurance companies, municipalities, contractors, doctors, lawyers, police officers, and educational institutions.

Some of his cases have been novel and unprecedented. He has also accepted cases rejected by other lawyers, including cases involving HPV transmission to a fiancée, a widow whose husband died by suicide, and allegations of excessive police force arising from a neighborhood dispute.

Baron has served as a Judge Pro Tem in Hayward and Oakland, participated on a settlement panel in San Francisco, and has been asked by judges in Contra Costa and Alameda Counties to serve as a mediator.
